DEC is authorized to regulate fishing in special management areas, including artificial reefs, wrecks, and surrounding areas. Regulations need to be formulated to implement this authority. The regulations will define wrecks, natural reefs, and artificial reefs in the same manner as they are already defined in the measures which banned fish pots on artificial reefs. The proposals may also include rocky areas around Fishers Island, where trawling is already prohibited by law and where restrictions on lobstering are being sought. The specific special management area regulations are being drafted and will be given to the Council for its review. Mr. Colvin stated that the focus of the proposed regulations will be to restrict mobile fishing gear, which damages bottom structure, and on gear which can become lost and foul the reef structure. It was observed that, in the future, protection of reef fishery resources themselves could also become an issue.
